Bungie is going through one of its most challenging times after its recent releases failed to meet expectations, dealing with a wave of layoffs and an internal crisis that raises doubts about the future of the PlayStation and Sony studio.
The problems for the developer of Destiny continue, as they now face a lawsuit. A writer has initiated a legal battle against Bungie, claiming the studio plagiarized his work to create part of the story for Destiny 2.
Bungie faces a lawsuit from a writer over Destiny 2 story
Writer Matthew Kelsey Martineau, also known as Caspar Cole, recently filed a lawsuit against Bungie. He claims that the studio copied parts of his work to create the storyline for Destiny 2.
On October 2, the creative filed the copyright infringement lawsuit with the United States District Court for the Eastern District of Louisiana. Specifically, Kelsey argues that Bungie plagiarized some of his writings that he published on WordPress between 2013 and 2014.
The writer claims that his work was used by the studio to create everything related to the Red Legion in the popular game. In his lawsuit, he explains that both narratives have many similarities and that Bungie copied his work without authorization. From his perspective, this has caused him "substantial, immediate, and irreparable" harm.
Kelsey demands the studio provide a list of all sales involving their productions that include his work and infringe on his copyright. Furthermore, he requests that the developer cease the distribution of any Destiny 2 content that bears similarities to his work.
On top of that, the lawsuit seeks compensation for damages, as well as a jury trial. As of the time of writing, neither Bungie nor Sony has commented on the matter, so it remains unclear what steps they will take to address it.
“The Red Legion forms the backbone for the entire storyline that unfolds in the infringement game of Destiny 2. Although Destiny 2 offers an immersive and thrilling gaming experience that keeps players on the edge of their seats, the game is based directly on Martineau's source work,” the lawsuit states.
