It is nothing new that the first next-gen consoles aren’t perfect. Some of them may present a problem or two. But even though it is not that likely to happen, this has been taken from something expected to happen to something expected never to happen.
The latest case went from a defective feature to a class action lawsuit against Sony. A PlayStation user is taking legal action against the company responsible for the console. Why? According to a PS5 user, it turns out that Sony hid crucial information about the console and a major flaw it could carry.
According to GameRant, Christina Trejo from Illinois is leading a class action lawsuit against Sony for knowing about this flaw and hiding it from its users. And it’s not just any flaw. It turns out that this defective feature causes the console to crash while used to play ANY game. Trejo has stated that she’s not the only one having this problem with the PS5, even with consoles that didn’t come out so long ago.
Christina Trejo attended a court session on July 12, where she presented all evidence and testimony proving how many people were showing the same problem. She stated that this was not any kind of flaw; it refrained the console from doing what it should. And Sony should take responsibility for this and pay for the damage done.
“While the PS5 can be used for many entertainment purposes, playing video games on the console is its primary function,” Trejo states. “The Console Defect affects users’ ability to play video games and compromises the primary function and overall usage of the PS5.”
Trejo also assured that Sony has direct knowledge about this matter but has been hiding this from its consumers: “However, despite its knowledge of the Console Defect, Defendant failed to, and continues to fail to, disclose the defect to consumers prior to them purchasing the PS5, nor has Defendant taken any substantial action to remedy the problem.”
According to Top Class Actions, “this is not the first lawsuit the company has faced over its products: Last year, Sony was hit with a lawsuit alleging it knowingly sells PlayStation 5s with defective controllers that “drift” in-game without prompting.”
